THE IMPLEMENTING PARTNER WILL PROVIDE FULL LEGAL CONTROL OF SITES PREVIOUSLY DESIGNED AND APPROVED FOR ANTICIPATED WETLAND AND RIPARIAN ZONE MITIGATION FOR WETLAND AND RIPARIAN ZONE IMPACTS FOR PLANNED SEGMENTS OF THE GREEN BROOK FLOOD RISK MANAGEMENT PROJECT (PROJECT). IMPLEMENTATION CONSTRUCTION OF THE MITIGATION PROJECT SITES WILL BE CONDUCTED IN FUTURE PHASES OF THE PROJECT. THE SERVICE ANTICIPATES THE MITIGATION REQUIREMENTS FOR THE PROJECT, BEYOND CONTEMPLATED MITIGATION BANK CREDIT PURCHASES, IS APPROXIMATELY 41.82 WETLAND MITIGATION UNITS AND 13.45 RIPARIAN ZONE UNITS. TASKS UNDER THIS AWARD INCLUDE SECURING FULL LEGAL CONTROL OF LAND WHICH WILL INCLUDE PURCHASING FEE TITLE OR PURCHASING EASEMENT(S) AND EXECUTION OF CONSERVATION EASEMENT(S) ON APPROVED MITIGATION SITE(S) COORDINATION WITH THE SERVICE AS WELL AS REGULATORY AGENCIES. TASK 12: COORDINATION WITH SERVICE AND REGULATORY AGENCIES THE NON-PROFIT PARTNER WILL MAINTAIN COORDINATION WITH THE SERVICE THROUGHOUT THE COMPLETION OF LAND CONTROL AND IMPLEMENTATION PROCESS. THE NON-PROFIT PARTNER SHALL HOLD MONTHLY PROGRESS MEETINGS NOT TO EXCEED TWO HOURS AND SHALL COPY FURNISH THE SERVICE WITH COPIES OF ALL LAND CONTROL DOCUMENTS, DEEDS, EASEMENTS, LEGAL DESCRIPTIONS, SURVEY EXHIBITS AND PERTINENT CORRESPONDENCE ASSOCIATED WITH TASK 13, BELOW. THE NON-PROFIT PARTNER WILL INCLUDE THE SERVICE IN ANY SITE OR COORDINATION MEETINGS ASSOCIATED WITH TASK 13. THE NON-PROFIT PARTNER WILL ALSO COORDINATE AND ATTEND REGULATORY AGENCY AND STAKEHOLDER MEETINGS AS REQUIRED DURING THIS PHASE OF WORK. COORDINATION WITH THE SERVICE IS REQUIRED AS PART OF FUTURE PROJECT PHASES (14 15-PROJECT IMPLEMENTATION) BUT NOT INCLUDED IN THIS TASK. TASK 13: SITE ACCESS FEE TITLE PURCHASE PURCHASE OF EASEMENTS AND EXECUTION OF CONSERVATION EASEMENT(S). THE NON-PROFIT PARTNER HAS PREVIOUSLY SECURED ACCESS AND APPROVALS TO THREE SITES TO PROVIDE THE CONTEMPLATED WETLAND AND RIPARIAN ZONE MITIGATION. THE THREE SECURED PROPERTIES CONSIST OF HOFFMAN ROAD MITIGATION SITE, BLOCK 32, LOT 6.06, MONROE TOWNSHIP, MIDDLESEX COUNTY, NJ ( 39.20 ACRES) NEW ROAD MITIGATION SITE, BLOCK 40, LOT 16.03, SOUTH BRUNSWICK TOWNSHIP, MIDDLESEX COUNTY, NJ ( 49.33 ACRES) AND LOWER RARITAN CENTER MITIGATION SITE, PORTION OF BLOCK 395, LOT 7, EDISON TOWNSHIP, MIDDLESEX COUNTY, NJ ( 109.49 ACRES). THE NON-PROFIT PARTNER WILL SECURE FULL LEGAL ACCESS TO THE THREE SITES APPROVED TO PROVIDE THE CONTEMPLATED MITIGATION. THE LEGAL VEHICLE TO ACQUIRE PERMANENT ACCESS TO AND PRESERVATION OF THE MITIGATION SITES WOULD TAKE THE FORM OF A PERMANENT CONSERVATION EASEMENT ACCEPTABLE TO STATE ENVIRONMENTAL REGULATORY AGENCIES. THE SCOPE OF THIS TASK INCLUDES PURCHASING FEE TITLE ON THE HOFFMAN ROAD AND NEW ROAD MITIGATION SITES, AND AN OPTION TO PURCHASE EASEMENT AGREEMENT ON THE LOWER RARITAN CENTER MITIGATION SITE WHERE A CONSERVATION EASEMENT IS BEING PURCHASED (INCLUDES CONTRACT OPTION PAYMENTS DEPOSITS LAND ACQUISITION AND CLOSING COSTS). CONSERVATION EASEMENTS SHALL BE RECORDED ON THE DEEDS AT THE COUNTY LAND RECORDS AFTER COMPLETION OF PROJECT IMPLEMENTATION (FUTURE TASKS 14 15).
