THE MONTANA LEGAL SERVICES ASSOCIATION (MLSA) AND THE NATIONAL ASSOCIATION OF INDIAN LEGAL SERVICES (NAILS) PROPOSE TO ENHANCE TRIBAL CIVIL JUSTICE SYSTEMS AND IMPROVE MEANINGFUL ACCESS TO JUSTICE WITHIN THE SERVICE AREAS OF 20 PARTICIPATING NAILS MEMBER PROGRAMS, WITH THE TECHNICAL SUPPORT OF THE NATIONAL AMERICAN INDIAN COURT JUDGES ASSOCIATION (NAICJA), UNDER THE TRIBAL CIVIL LEGAL ASSISTANCE GRANT. TO MEET THIS GOAL, MLSA, THE NAILS MEMBER PROGRAMS, AND NAICJA WILL TAKE A FOURFOLD APPROACH: (1) PROVIDING DIRECT CIVIL LEGAL ASSISTANCE TO TRIBAL MEMBER CLIENTS, (2) ENGAGING WITH TRIBES TO PROVIDE CAPACITY-BUILDING SERVICES, (3) PROVIDING TECHNICAL ASSISTANCE TO TRIBES AND OTHER NAILS MEMBER PROGRAMS, AND (4) PROVIDING ASSISTANCE WITH OTHER PROJECTS DESIGNED TO MEET THE NEEDS OF LOCAL TRIBAL COMMUNITIES. THE MONTANA LEGAL SERVICES ASSOCIATION (MLSA) AND THE NATIONAL ASSOCIATION OF INDIAN LEGAL SERVICES (NAILS) PROGRAMS PROPOSE TO ENHANCE TRIBAL CRIMINAL JUSTICE SYSTEMS AND IMPROVE MEANINGFUL ACCESS TO JUSTICE WITHIN THE SERVICE AREAS OF THE 17 PARTICIPATING NAILS MEMBER PROGRAMS, WITH THE TECHNICAL SUPPORT OF THE NAICJA, UNDER THE TRIBAL CRIMINAL LEGAL ASSISTANCE GRANT. TO MEET THIS GOAL, MLSA, NAILS, AND NAICJA WILL TAKE A FOURFOLD APPROACH: (1) PROVIDE DIRECT CRIMINAL LEGAL ASSISTANCE TO AT LEAST 800 INDIVIDUALS FOR PUBLIC DEFENSE IN TRIBAL COURTS, (2) PROVIDE FOUR TRIBES CAPACITY BUILDING SERVICES SUCH AS TRIBAL LAW AND ORDER ACT AND VIOLENCE AGAINST WOMEN ACT EDUCATION AND 5 IMPLEMENTATION, (3) PROVIDE FIVE TECHNICAL ASSISTANCE EVENTS TO TRIBES AND NAILS PROGRAMS, AND (4) PROVIDE ASSISTANCE WITH OTHER PROJECTS DESIGNED TO MEET THE NEEDS OF LOCAL TRIBAL COMMUNITIES. MLSA WILL ADMINISTER AND COORDINATE THE GRANT, INCLUDING MONITORING GRANT COMPLIANCE AMONG THE 17 SUBGRANTEES. PROJECT DELIVERABLES INCLUDE SIGNED MOUS FROM SUBGRANTEES AND NAICJA DISTANCE LEARNING MODALITY COURSE OR TRAINING MODULE. MLSA, THE NAILS PROGRAMS, AND NAICJA WILL SUBMIT DATA AND REPORTS TO BJA ON A REGULAR BASIS. MLSA AND THE NAILS COALITION EXPECT THE PROPOSED SERVICES AND PROJECTS WILL RESULT IN INCREASED ACCESS TO CRIMINAL LEGAL DEFENSE SERVICES FOR INDIVIDUALS CHARGED WITH CRIMES IN TRIBAL COURTS, AS WELL AS AN OVERALL STRENGTHENING OF INDIVIDUAL TRIBAL JUSTICE SYSTEMS THROUGH CAPACITY-BUILDING PROJECTS. ULTIMATELY, THE PROPOSED PROJECT WILL HELP ENSURE DUE PROCESS, PROTECT THE CONSTITUTIONAL AND CIVIL RIGHTS OF NATIVE AMERICAN DEFENDANTS, AND ALLOW TRIBES TO DEVELOP TRIBAL CODES AND ORDINANCES, WHICH PROMOTE TRIBAL SOVEREIGNTY.

FLORIDA LEGAL SERVICES CONNECTING KIDS TO COVERAGE PROJECT - FLORIDA LEGAL SERVICES (FLS) IS REQUESTING $1,500,000 TO CONDUCT A 3-YEAR ‘CONNECTING FAMILIES TO COVERAGE’ PROJECT THAT WILL CONNECT AND HELP ENROLL/REENROLL FAMILIES THROUGHOUT FLORIDA INTO MEDICAID AND CHIP COVERAGE. THE PROJECT WILL SERVE ALL FLORIDA FAMILIES ELIGIBLE FOR MEDICAID AND CHIP, INCLUDING CHILDREN, PARENTS, AND PREGNANT WOMEN. OVERALL, FLORIDA HAS BEEN IDENTIFIED AS ONE OF SIX STATES WHERE CHILDREN ARE ESPECIALLY AT RISK OF LOSING HEALTH CARE COVERAGE. THE PROJECT WILL TARGET EDUCATION AND OUTREACH TO TWO DISTINCT FLORIDA REGIONS WHERE CHILDREN AND FAMILIES ARE AT ESPECIALLY HIGH RISK OF LOSING COVERAGE OR REMAINING UNINSURED: THE NORTH-CENTRAL FLORIDA/BIG BEND REGION, AND ORANGE-OSCEOLA COUNTIES IN CENTRAL FLORIDA. THE NORTH-CENTRAL FLORIDA/BIG BEND REGION CONSISTS OF PRIMARILY RURAL COUNTIES WITH HIGH POVERTY RATES AND SIGNIFICANT ACCESS BARRIERS TO THE ENROLLMENT PROCESS. THE ORANGE-OSCEOLA REGION HAS SOME OF THE HIGHEST POPULATIONS OF HISPANIC/LATINO PEOPLE IN THE STATE, WHO ARE AT A PARTICULARLY HIGH RISK OF GOING WITH MEDICAID OR CHIP COVERAGE DESPITE BEING ELIGIBLE. FLS WILL USE CMS FUNDS TO SUPPORT A PROJECT DIRECTOR, 3 OUTREACH AND ENROLLMENT SPECIALISTS, A GRANT ADMINISTRATIVE ASSISTANT, AND A PART-TIME INTAKE AND CLIENT FOLLOWUP ASSISTANT. AN FLS ATTORNEY WHO HAS SPENT THE MAJORITY OF HER 25-YEAR LEGAL CAREER CONCENTRATING ON HEALTH CARE ACCESS ISSUES AND WHO HAS SUBSTANTIAL EXPERIENCE ASSISTING FAMILIES WITH ACCESSING MEDICAID AND CHIP COVERAGE IN FLORIDA WILL ACT AS THE PROJECT DIRECTOR. THE REMAINING STAFF WILL BE HIRED AND TRAINED WITHIN THE FIRST 90 DAYS OF THE PROJECT, DURING THE MANDATORY PLANNING PERIOD. WE WILL ALSO RECRUIT LAW STUDENT INTERNS TO PROVIDE ASSISTANCE TO PROJECT STAFF. PROJECT STAFF WILL CONDUCT MULTI-PRONGED OUTREACH TO REACH FAMILIES WHO MAY BE ELIGIBLE FOR COVERAGE, INCLUDING: INTERNAL CLIENT REFERRALS FROM OTHER FLS PROGRAMS; THIRD-PARTY REFERRALS FROM LOCAL LEGAL SERVICES AND COMMUNITY PARTNERS; COMMUNITY NETWORKING AND OUTREACH EVENTS; AND A ROBUST SOCIAL MEDIA CAMPAIGN AND PUBLIC SERVICE ANNOUNCEMENTS TO ENCOURAGE SELF-REFERRALS. PROJECT STAFF WILL ALSO ACCEPT REFERRALS, COMPLETE CLIENT INTAKES, AND ASSIST ELIGIBLE FAMILIES IN COMPLETING APPLICATIONS, WITH REGULAR FOLLOW-UP UNTIL THE ELIGIBILITY DETERMINATION IS MADE. OUTREACH AND CLIENT ASSISTANCE WILL BE CONDUCTED BOTH IN PERSON AND THROUGH VIRTUAL PLATFORMS. OVERALL, WE ANTICIPATE ACCOMPLISHING THE FOLLOWING MEDICAID/CHIP OUTCOMES UNDER THE PROJECT: 2,105 CHILDREN WITH HEALTH COVERAGE APPLICATIONS SUBMITTED; 2,035 CHILDREN NEWLY ENROLLED IN MEDICAID/CHIP; 1,200 CHILDREN RENEWED IN MEDICAID/CHIP; 975 PARENTS WITH HEALTH COVERAGE APPLICATIONS SUBMITTED; 705 PARENTS NEWLY ENROLLED IN MEDICAID; 1,050 PARENTS RENEWED IN MEDICAID; 240 PREGNANT WOMEN WITH HEALTH COVERAGE APPLICATIONS SUBMITTED; 195 PREGNANT WOMEN ENROLLED IN MEDICAID/CHIP; 195 PREGNANT WOMEN (POST-PARTUM) RENEWED IN MEDICAID/CHIP.

THE NORTH DAKOTA HUMAN TRAFFICKING TASK FORCE (NDHTTF) SERVES THE ENTIRE STATE OF NORTH DAKOTA (ND), WHICH INCLUDES FIFTY-THREE COUNTIES AND FIVE INDIAN RESERVATIONS, AS WELL AS THE TRENTON INDIAN SERVICE AREA. THE NDHTTF HEADQUARTERS ARE LOCATED IN BISMARCK, ND, CENTRAL TO THE STATE. THE TASK FORCES OPERATIONAL TEAMCOMPRISED OF VICTIM WITNESS SPECIALISTS/NAVIGATORS, BCI AGENTS, A TRIBAL NATIONS ENGAGEMENT ADVISOR, A SURVIVOR LEADER, A LABOR TRAFFICKING SPECIALIST, AND HSI AGENTSIS SPLIT BETWEEN TWO LOCATIONS, BISMARCK AND FARGO, TO PROVIDE LEADERSHIP IN THE EASTERN AND WESTERN PARTS OF ND. THE NDHTTF USES NINE MULTIDISCIPLINARY (MDT) TEAMS IN COMMUNITIES THROUGHOUT ND TO WORK WITH THE OPERATIONAL TEAM AND PROVIDE DIRECT VICTIM RESPONSE, INVESTIGATE, AND PROSECUTE CASES OF HUMAN TRAFFICKING, BOTH LABOR AND SEX TRAFFICKING.

THE PROJECT’S GOALS ARE: 1) TO ENROLL OR RETAIN 600 ELIGIBLE CHILDREN IN MEDICAID AND CHIP, 2) TO ENROLL 200 PREGNANT WOMEN IN MEDICAID; 3) TO ENROLL 150 PARENTS IN MEDICAID; 4) TO HANDLE 1,000 REQUESTS FOR ENROLLMENT AND RENEWAL ASSISTANCE THROUGH THE PROJECT'S HELPLINE; AND 5) TO IDENTIFY AND ADDRESS SYSTEMIC BARRIERS TO ENROLLMENT AND RETENTION DURING THE THREE YEAR COOPERATIVE AGREEMENT FUNDING PERIOD. TO ACHIEVE THIS, LEGAL SERVICES RESPECTFULLY REQUESTS $798,638 OVER THREE YEARS TO DEDICATE THREE FULL-TIME PROJECT STAFF MEMBERS (ONE PROJECT DIRECTOR WHO IS A CURRENT EMPLOYEE, AN OUTREACH COORDINATOR WHO IS A CURRENT EMPLOYEE, AND ONE OUTREACH AND ENROLLMENT SPECIALIST TO BE HIRED) TO TRAIN 10 SCHOOL NURSES IN 5 SCHOOL DISTRICTS; 10 HOMELESS ENROLLMENT COORDINATORS IN 10 DIFFERENT SCHOOL DISTRICTS AND AT 5 COMMUNITY PARTNER AGENCIES; RECEIVE 1,000 REQUESTS FOR MEDICAID ENROLLMENT AND RENEWAL ASSISTANCE VIA THE PROJECT HELPLINE; AND IDENTIFY AND ADDRESS SYSTEMIC BARRIERS TO ENROLLMENT AND RETENTION THAT WILL FLOW DIRECTLY FROM THE PROBLEMS EXPERIENCED BY INDIVIDUAL CLIENTS. ULTIMATELY, THE PROJECT WILL ENSURE THAT LOW-INCOME MISSOURIANS OBTAIN HEALTH INSURANCE COVERAGE THAT TRANSLATES INTO MEANINGFUL ACCESS TO HEALTH CARE.

LEGAL ASSISTANCE IS ASSISTANCE IN: A) DIVORCE, PARENTAL RIGHTS, CHILD SUPPORT, TRIBAL, TERRITORIAL, IMMIGRATION, EMPLOYMENT, ADMINISTRATIVE AGENCY, HOUSING, CAMPUS, EDUCATION, HEALTHCARE, PRIVACY, CONTRACT, CONSUMER, CIVIL RIGHTS, PROTECTION OR OTHER INJUNCTIVE PROCEEDINGS, RELATED ENFORCEMENT PROCEEDINGS, AND OTHER SIMILAR MATTERS; B) CRIMINAL JUSTICE INVESTIGATIONS, PROSECUTIONS, AND POST-CONVICTION MATTERS (INCLUDING SENTENCING, PAROLE, AND PROBATION) THAT IMPACT THE VICTIMS SAFETY, PRIVACY, OR OTHER INTERESTS AS A VICTIM; C) ALTERNATIVE DISPUTE RESOLUTION, RESTORATIVE PRACTICES, OR OTHER PROCESSES INTENDED TO PROMOTE VICTIM SAFETY, PRIVACY, AND AUTONOMY, AND OFFENDER ACCOUNTABILITY, REGARDLESS OF COURT INVOLVEMENT; OR D) POST-CONVICTION RELIEF PROCEEDINGS IN STATE, LOCAL, TRIBAL, OR TERRITORIAL COURT, WITH RESPECT TO A CONVICTION OF A VICTIM RELATING TO OR ARISING FROM DOMESTIC VIOLENCE, DATING VIOLENCE, SEXUAL ASSAULT, STALKING, OR SEX TRAFFICKING VICTIMIZATION OF THE VICTIM. THROUGH THIS CONTINUATION LEGAL ASSISTANCE FOR VICTIMS PROJECT, ANISHINABE LEGAL SERVICES, IN PARTNERSHIP WITH LEGAL SERVICES OF NORTHWEST MINNESOTA, FAMILY SAFETY NETWORK, AND NORTHWOODS BATTERED WOMENS SHELTER, WILL PROVIDE VICTIMS OF DOMESTIC ABUSE, DATING VIOLENCE, SEXUAL ASSAULT, AND STALKING A FULL RANGE OF CIVIL LEGAL SERVICES, MAKE REFERRALS TO CIVIL LEGAL AID PROGRAMS, AND PROVIDE OUTREACH ABOUT PROJECT ACTIVITIES AS WELL AS HELP TO IDENTIFY ADDITIONAL NEEDS, BARRIERS, AND/OR EMERGING ISSUES FACING VICTIMS. THE GEOGRAPHIC SERVICE AREA IS LEECH LAKE, WHITE EARTH, AND RED LAKE INDIAN RESERVATIONS AND NEARBY COMMUNITIES IN RURAL NORTHWESTERN MINNESOTA. THIRTEEN TYPES OF ASSISTANCE MAY BE PROVIDED THROUGH THE CONTINUUM OF CARE (COC) PROGRAM: (1) COC PLANNING ACTIVITIES/COSTS FOR DESIGNING AND CARRYING OUT A COLLABORATIVE PROCESS FOR THE DEVELOPMENT OF AN APPLICATION TO HUD; (2) UNITED FUNDING AGENCY (UFA) COSTS FOR FISCAL CONTROL AND ACCOUNTING NECESSARY TO ASSURE THE PROPER DISBURSAL OF, AND ACCOUNTING FOR, FEDERAL FUNDS AWARDED TO SUBRECIPIENTS UNDER THE CONTINUUM OF CARE PROGRAM, (3) ACQUISITION OF REAL PROPERTY (INCLUDING STRUCTURES) FOR USE IN THE PROVISION OF HOUSING OR SUPPORTIVE SERVICES; (4) REHABILITATION OF STRUCTURES TO PROVIDE HOUSING OR SUPPORTIVE SERVICES; (5) NEW CONSTRUCTION, INCLUDING THE BUILDING OF A NEW STRUCTURE OR BUILDING AN ADDITION TO AN EXISTING STRUCTURE FOR USE AS SUPPORTIVE HOUSING; (6) LEASING OF A STRUCTURE OR STRUCTURES, OR PORTIONS THEREOF, TO PROVIDE HOUSING OR SUPPORTIVE SERVICES; (7) RENTAL ASSISTANCE, WHICH MAY BE SHORT-TERM, MEDIUM-TERM, OR LONG-TERM, AS WELL AS TENANT-BASED, PROJECT-BASED, OR SPONSOR-BASED, FOR TRANSITIONAL OR PERMANENT HOUSING; (8) SUPPORTIVE SERVICES TO ASSIST PROGRAM PARTICIPANTS OBTAIN AND MAINTAIN HOUSING; (9) OPERATING COSTS OF SUPPORTIVE HOUSING; (10) COSTS OF IMPLEMENTING AND OPERATING HMIS; (11) PROJECT ADMINISTRATIVE COSTS; (12) RELOCATION COSTS; AND (13) INDIRECT COSTS IN ACCORDANCE WITH 2 CFR PARTS 200, AS APPLICABLE. IN ADDITION TO USING GRANT FUNDS FOR THE ELIGIBLE COSTS DESCRIBED ABOVE, RECIPIENTS AND SUBRECIPIENTS IN CONTINUUMS OF CARE DESIGNATED AS HIGH PERFORMING COMMUNITIES MAY ALSO USE GRANT FUNDS TO PROVIDE HOUSING RELOCATION AND STABILIZATION SERVICES AND SHORT- AND/OR MEDIUM-TERM RENTAL ASSISTANCE TO INDIVIDUALS AND FAMILIES AT RISK OF HOMELESSNESS AS SET FORTH IN 24 CFR 576.103 AND 24 CFR 576.104, IF NECESSARY TO PREVENT THE INDIVIDUAL OR FAMILY FROM BECOMING HOMELESS. LIMITATION ON USE OF FUNDS: NO ASSISTANCE PROVIDED UNDER PROGRAM (OR ANY STATE OR LOCAL GOVERNMENT FUNDS USED TO SUPPLEMENT THIS ASSISTANCE) MAY BE USED TO REPLACE STATE OR LOCAL FUNDS PREVIOUSLY USED, OR DESIGNATED FOR USE, TO ASSIST HOMELESS PERSONS OR PERSONS AT-RISK OF HOMELESSNESS.; EXPECTED OUTCOMES: DECREASE IN THE NUMBER INDIVIDUALS AND FAMILIES EXPERIENCING HOMELESSNESS, MORE SPECIFICALLY USING PERFORMANCE INDICATORS SUCH AS THE LENGTH OF TIME HOMELESS, RETURNS TO HOMELESSNESS OVER TIME, AND EXITS TO PERMANENT HOUSING.
